Terms of service

These terms apply to the use of FitCoUp, a platform operated by ZBL Company BV, registered in Belgium ("FitCoUp", "we"). They cover creators who run a school on the platform and students who use a school. By creating an account you accept these terms.

No card required. Cancel anytime.

1. Accounts and roles

A creator account is opened by a person authorized to act for the school. The creator can invite team members and assign roles; the creator is responsible for their actions. A student account is created when a person signs up in a school, buys a product or accepts an invitation. Every account holder must keep the login secure and must be at least 18 years old, or use the service under the supervision of a parent or guardian where local law allows it.

2. Plans, trials and payments

Creators choose a plan billed monthly or yearly in EUR. The free trial lasts 14 days and requires no card; a plan starts only when the creator chooses one. Upgrades apply immediately with a credit for the unused days of the current plan; downgrades apply at the end of the paid period. Plan payments are processed by Stripe. FitCoUp does not charge a percentage of a creator's sales.

Student payments go to the creator's own Stripe account through Stripe Connect. The creator is the seller of record toward students and is responsible for prices, taxes, refunds and the content sold. FitCoUp provides the tools for trials, subscriptions, refunds and cancellation and does not hold the creator's money.

3. Content and ownership

Creators keep every right to the programs, videos, texts, images and brands they upload. By uploading, the creator grants FitCoUp the technical license needed to store, process and deliver the content to students. The creator confirms that they hold the rights to the content and that it does not infringe the rights of others. FitCoUp keeps every right to the platform, its software, templates and design.

4. Acceptable use

  • No content that is illegal, misleading, infringing or harmful, and no medical claims that the creator is not qualified to make.
  • No sending of marketing messages to students who have not given marketing consent.
  • No attempts to access other schools, break the service or circumvent limits of a plan.
  • No use of student data for purposes beyond running the school and what the student consented to.
  • FitCoUp may suspend a school for a violation; the dashboard shows the reason, and payments already made are not affected by the suspension.

5. Data protection

For student data, the creator is the controller and FitCoUp is the processor acting on the creator's instructions, as described in the privacy policy. FitCoUp processes data in the European Union, applies access controls and audit logs, stores health data only after explicit consent, and provides export and deletion tools to creators and students.

6. Availability and support

FitCoUp aims to keep the service available at all times and announces planned maintenance in advance. Support is provided from the dashboard with the response time shown on each ticket; Enterprise and Agency plans include a service level agreement.

7. Liability

FitCoUp provides software. The creator is responsible for the programs, advice and results offered to students. To the extent permitted by law, FitCoUp's liability for any claim related to the service is limited to the amount the creator paid for the service in the twelve months before the claim. FitCoUp is not liable for indirect damages, lost profits or data lost through actions of the account holder.

8. Termination and export

A creator can cancel at any time from the dashboard; the school stays live until the end of the paid period, and the creator can export students, progress and sales before and after that date. FitCoUp can end an account for a material violation of these terms after a notice, except where immediate action is needed to protect students or the service. After termination, data is deleted according to the retention periods in the privacy policy.

9. Changes and law

We may update these terms; material changes are announced in the dashboard at least 30 days before they apply. Belgian law applies, and disputes are brought before the courts of Belgium, without affecting mandatory consumer rights of students in their own country.

Questions

Who is the seller when a student buys a program?

The creator. Payments go to the creator's Stripe account, and the creator sets prices, taxes and refund rules within the tools FitCoUp provides.

Can I leave with my data?

Yes. Export of students, progress and sales is available at any time from the dashboard, and there is no contract beyond the paid period.

What happens if a school is suspended?

The dashboard shows the reason, scheduled messages pause and the student app shows a maintenance screen. Payments already made are not reversed by the suspension.
